I can't possibly put into words the humiliation I experienced. My defense. Attorney, Pete Comar had me set up to plead guilty to a felony trespassing that was clearly a misdemeanor (when I fired Comar judge Gonzalez agreed). The victim never responded to the court, the house in question was certainly not a dwelling by Colorado law. In fact by Colorado law definition it was a "public house". It was 36 degrees below zero the night of the offense and because I had a dog the la puente could not take me in. They recommended I take refuge at "the blue house" la puente's unofficial overflow. And that is what I did.
The probation pre sentence report recommended two years in community corrections. No victim, misdemeanor, the lesser of two evils and zero aggravating factors... So I went (strictly against Comar's advice) to judge Gonzalez, Gonzalez appointed a new defense attorney took my hand written motion into his Chambers and 15 minutes later I had a misdemeanor. The Honorable Judge Gonzalez did in fact thank me for "educating the court" that day. The presentence report and recommendation were absurd. So if you have a misdemeanor and you would like two years in comcor go to district 12 and Pete Comar can make it happen. Meanwhile if you are the victim of a crime in district 12 nodody seems to care.
